All
orders placed with PDXTUNING, INC. (via
phone, fax, mail, e-mail, web cart &
will call) constitute the acknowledgment
and acceptance of all conditions listed
below. All parts shall remain the
property of PDXTUNING, INC. until paid
in full. All prices, materials, design
and specifications are subject to change
without notice. PDXTUNING, INC. reserves
the right to make changes in design,
material, and specifications or to make
product changes as deemed necessary
without prior notice. PDXTUNING, INC.
reserves the right to change the design
of any product without assuming any
obligation to modify any product
previously manufactured.
Return
for an exchange or refund will be
allowed only within 7 calendar days from
the date of the receipt and must be
authorized by PDXTUNING, INC prior to
shipping. All authorized returned
merchandise must be unused and in its
original salable packaging. No returns
or exchanges on merchandise that shows
signs of having been opened, installed,
modified, mounted, scratched or defaced
will be allowed. Returns must be sent
freight prepaid and insured by you. A
refund or exchange will not be
considered until all relevant items,
hardware, and accessories have been
returned to PDXTUNING, INC. Original
shipping and handling charges are not
refundable. All custom entry fees and
duty associated with any return or
exchange will be charged to the
customer.
Contact
your sales person for a Return
Merchandise Authorization (RMA) number
prior to returning merchandise to
PDXTUNING, INC. All opened/used
merchandise approved for return is for
CREDIT ONLY!! No exceptions. Returned
merchandise must be sent freight and
insurance prepaid. COD's or freight
collect orders will be refused.
RMA number must be plainly marked on
outside of all boxes. Boxes
without RMA displayed appropriately will
be refused. 20% restocking fee on all
returns in "as new" sellable condition.
If returned goods are not in "as new"
condition an additional charge will be
added. No credit will be issued for
damaged, installed or deformed items. No
returns after 30 days from original
invoiced date.
A
photocopy of your invoice showing the
invoice number must accompany your
return along with a written explanation
and a contact phone number where we may
reach you. It is the responsibility of
the customer/installer to verify the
correctness of the size and application
of the parts before installation. NOTE:
Any return credits or refunds are
processed on the last business day of
each month. Please allow an additional
12-14 working days for credit card
refunds to post to your account.
Merchandise received and accepted is
assumed delivered in full. Shortage
claims must be made within 5 working
days of receipt date. All claims for
damaged merchandise must be made with
the carrier. All shortages or damaged
goods must be claimed with the freight
company and reported at customer dock or
claim will not be honored. A copy of
invoice/freight bill must accompany all
claims. Once report has been made
forward all pertinent documents to
PDXTUNING, INC. Please keep all shipping
cartons and all packing materials for
carrier inspection. Failure to provide
the original shipping container for
inspection will void all claims for
reimbursement. Customer is responsible
for all fees, charges, and voided claims
incurred due to missing packaging.
PDXTUNING, INC. cannot initiate any
claims with the carrier. All approved
refunds will be paid by either company
check, credit card, or account credit,
to be determined by PDXTUNING, INC..,
once all claims have been settled with
the shipping company.
A 20%
restocking fee will be assessed on all
authorized returns in addition to any
original shipping fees. Any refused
shipment sent back to PDXTUNING, INC.
does not constitute the right to a
refund or credit. It is the customer's
responsibility to make all arrangements
with PDXTUNING, INC. for the refused
shipment prior to its refusal. All
refused shipments will be charged
shipping fees to and from PDXTUNING,
INC. including drop ship fees,
residential fees and address correction
fees, if applicable, and storage fees.
WARRANTY; No warranty will be valid if
the defect was caused by customers
abuse, negligence, and mishandling.

each part for specific warranty terms
and disclaimers.) Customer, however,
will be responsible for all shipping and
handling fees. No labor or inconvenience
may be included in any claims. There is
no warranty on apparel, decals,
electrical parts, and engine parts .
Check your federal and local laws
regarding the use of any parts. In the
event that legal proceedings are
required to resolve disputes, all claims
and filings must be made with the
Washington County Municipal Court
located in Hillsboro, Oregon. PDXTUNING,
INC. customers will acknowledge and
agree to these stipulations once any
transaction has been made with PDXTUNING,
INC.
Many
items offered for sale through PDXTUNING,
INC. are not manufactured, designed, or
sold for any use on public streets and
highways. (See current PDXTUNING, INC.
price lists for more details on any
items that fall into this category. Your
sales representative should be contacted
for answers to any questions prior to
offering these items for retail sale or
to resale customers.) These items are
manufactured, designed and sold strictly
for "off-road" use on vehicles not
controlled by any form of emissions
control device, and/or strictly for
export beyond the United States.
Dealers, agents and retail customers are
all responsible for obtaining
verification that the user is going to
use said item in its intended fashion.
Failure to obtain this verification can
place the Dealer/consumer in violation
of the Federal Clean Air Act,
enforceable by the EPA and other
governmental agencies. This violation
will place the Dealer agents and resale
customers subject to both monetary fines
and/or imprisonment. PDXTUNING, INC.
requires all consumers to contact legal
counsel prior to offering for sale any
items produced by PDXTUNING, INC. and
obtain proper operating procedure for
sale of these items. Furthermore,
PDXTUNING, INC, will offer a penalty
free return policy for all un-installed
"off-road" items to any of its
customers. Retail customers cannot be
forced to accept items that they may not
have known were in violation of the
Federal Clean Air Act until they were
physically received and warnings
enclosed in the product were reviewed!
Any
digital or printed material using any
copyrighted or trademarked material
belonging to PDXTUNING, INC. must have
written permission by a PDXTUNING, INC.
representative prior to its use. Use of
any images without authorization is
prohibited.
